View Full Version : Who are you leaving DVC to?

Very morbid question, sorry. It seems I can no longer avoid it, and DH and I will be drawing up our wills in the near but not immediate future.

As a committed DINK, I never gave much thought to deeding DVC to any of our invisibile children. But I got to leave this baby to somebody. I have 2 sets of nieces and nephews. The first would likely use it, but could not be trusted for the Annual Dues, their mom has a hard enough time making ends meet. The second are Disney dislikers, and I just can't will the magic to someone who isn't "into it".

Leaves me with a intresting dilema, didn't know if anybody is in the same boat......

okay, DINKS, let's get this forum active! :solikeiwa

Leave it to? But Im not going anywhere! :D

Seriously...although I am not a DINK I own my points myself...(they are mine...all mine! Evil laugh!!)
So they are going to my kids...but not for a VERY long time I hope! :)

Its really not a morbid question Roz I believe it to be a sensible question...an option (shudders at the thought but) could be that it could be sold and put into your estate.

One option may be to leave it to a charitable foundation or establish a trust--either of which could either rent it out or use it as a fundraising method or as some part of a charitable process. Someone like Give The Kids The World might be a thought.

Well, we left everything first to each other, of course, and then to nieces and nephews, presuming that our executors will liquidate everything and then split the "spoils" equally among the lot. It didn't make sense to try to leave specific items to specific individuals; then we wouldn't know what to do with house, cars, DVC, artwork, etc. We couldn't leave the house to X, Y, and Z, and then let them duke it out or try to buy each other out when they will be at different ages, have different life circumstances, etc.

We're leaving them to each other, as well. Followed by my nephew (my sister's son). My one BIL is already a DVC member, so his kids are taken care of. I, too, haven't really gave it much thought, even though I really should have. shame, shame. :tsktsk:

I'll be 83 when my contract expires. IMO years before that, DVC will offer some kind of re-up contract to either extend for another 50 or some other amount of time. If either of my kids want to pay the price to extend it, then they can have it when I croak. If I die before 2042, then the kids get bonus years. If I live beyond 2042 then they just have to wait a little longer.

Wonder if they feel lucky ?!?!? Better be carefull what I eat when I visit them.

I'm in! I figure DH and I will be at least 90 when DVC expires (I can't remember the exact date). Matter of fact, our financial advisor tried to ask us hesitantly how long we expected to be retired. So I told him flat out, "When our DVC expires, so do I!" Just singing on my porch at OKW, "It's 5:00 somewhere"

I think I'd do like Kim. Liquidate and distribute evenly. I'd like to earmark the $ for rducation now, and howpefully live long enough that htey are all done with education by the time I go. Still need to work on a will, though.

That's exactly what we did. They have to use the $$ for education, up to the point of a bachelor's degree -- at which time they can get the $$. If they don't use it for education, they can't get the $$ until they're 25 (when they can maybe use it to buy a house, etc., but hopefully not blow through it in the way an 18 year-old might).

Yeah, that's pretty restrictive, but the nature of our families kinda dictates that we do it this way. It was tough, because we didn't want to force anyone to go to college, but we wanted to make sure that they would be mature enough to handle the $$ when they get it.

I have no idea who's getting our DVC, heck I'm not even clear what we are doing with our kids if something happens to us(shame, I know). I'm sure the girls will fight over it. We have 2 contracts and 3 kids. I plan to go to WDW even when I'm old! I can ride all the grandkids around on my ECV! Seriously, we would probably give some of it to my SIL (she would probably get the kids, too). It would just depend if she wanted to pay the dues or not. If not, we'd probably do like Kim and sell it, and then have the money split between the girls.

Rozzie- seriously, I will be glad to take over your SSR points and use them in your honor should the unthinkable happen. Since I'm closest to you geographically, I think you should choose me over TW1!:hahahaha:

But Rozzie, you are my newest best friend and I promise to buy you Dole Whips at every DisMeet! Pick memememememememe.

I bought DVC with my daughter in joint tenancy, so that takes care of THAT!

But I remember when she was little and asking me whether or not she would get my beaded gown if I died? And I remember clearly saying 'only if i die under natural circumstances'.

With kids, ya never know WHAT they are thinking!

But the trick is to avoid probate if at all possible.

We are also DINKS (well for this week and next, I picked up some contract work) and I also will be 88 when DVC runs out. Great question. We have 3 little nieces that would probably love it, but I don't plan on expiring before the DVC does! Just kidding, I don't want to live THAT long. Yes, we will probably leave it to a niece or 2 or 3 or 4. We probably ought to get a will going one if these days.......

good question.

I had planned on my niece getting most of my OKW points plus SA.

then my nephew getting my BWV, VWL and PCB.

but I think your way is probably better.

my family has a nasty habit of stealing from each other.....

Mother got cheated out of millions by her sister....:holymoly: (and no I am not kidding)

Now I need to find someone to be the executor....hard decision.

of course I could always sell them.

I was going to put some of my 401K money aside in an annuity to pay the dues until DVC expiries....

there are so many choices....

I fully intend to be around and healthy enough to use every last minute of my DVC.

But at this point unless anything changes in my life, all my goodies will go to my sister. (I know that she would really enjoy it as she is a Pooh freak but hasn't been to a Disney park since she was a teen!)

She is going to have quite the treasure hunt - she doesn't know that I own DVC, I have bank accounts in 3 countries, pension plans in 3 countries, etc etc etc. I know that I need to list all my assets one day soon 'just in case', but think of all the fun surprises she'll have if anything happens to me, and she has to go hunting for my money! :D

I was thinking of something far too complicated. Like each of the 3 kids got one years points in rotation. Boy would that complicate banking and borrowing! :ROTFL: Or I have to get busy and buy many more points so they can each have some.

They already have some weird plans to divide up my Dept 56 North Pole collection. I don't want to know.

We have other time shares, three weeks, one for each of the kids. One at the beach for the yougest daughter, one at the golf course for the son and one at the lake for the oldest daughter. And now DVC which will probably be a joint venture for all of them. Eventually we will have to add on another 150-200 points to reach our goal. We will also be in our 90s when our points run out. And the youngest will be in her 60's, the oldest(our son) will be in his 70's.

You know, I haven't ever thought about it. My first answer would be to my niece and nephew, but as they are only 6 and 2 right now, I couldn't exactly leave it directly to them, and their parents (my brother and sis-in-law) already own 300 points at BCV!

Hmm. My parents are only in their 50s, so if an accident should happen to us anytime soon, I guess I would give it to them. They *love* WDW... they're the ones who instilled the love in me.

We have another nephew... my husband's nephew... but his mother refuses to even let us take him to WDW (well, he's just a baby right now, but we discussed it with her in terms of the future) because she hates "the man." She would let us take him on other trips, but not to WDW.

So, I don't know. We're leaning toward not having kids of our own.

But if I don't, they go to DH. If he predeceases me, I'll be changing my will, so not sure who they will go to. I'll probably have to sell them as I doubt I could afford the fees if Im alone.

lenshanem
07-18-2006, 03:50 AM
I'll be 70 when they expire and DH will be 68 sooo hopefully we'll still be around to see the contracts end.

But if not we have four contracts -
150 BCV
50 BCV
60 VWL
40 VWL

So one daughter can take the 150 BCV and our other daughter can take the 50 BCV, 60 VWL and 40 VWL.

Our wills are old (pre DVC purchases) and we basically did a very basic one - sorta an even split between siblings.

Is DVC something that has to be specifically named in the wills? Or would it be considered just part of our estate?

I am not a lawyer (obvious to most), but having been through the settling of two wills recently I would suggest EVERYTHING is spelled out. Leave nothing to be second guessed. It is very very sad what I have seen happen when family members pass on and the kids start bickering over who gets what. Even the most loving of siblings can ruin their relationship of the most trivial of their parents belongings.

You're right. I've actually seen this myself, too. It is very sad.
We made our will when I was pregnant with my first and we made it so it would cover future children. I know it needs to be redone. Ugh.

Either/or. You can stipulate that if they cannot agree to the split you have delineated (VWL plus a little BCV thrown in vs. all BCV) or they cannot come to terms with having to choose, then the asset can be liquidated and the proceeds split evenly.

OK - so I'll be 80 when SSR contract expires..... but I can borrow on that last year - so we'll call it 79! I have every intention of living out all of those years - and I really like the idea of "kicking it" out on the balcony. I may have to bring an nurse aid with me..... that's alright - someone to fetch more margaritas!
Well - we do have 2 kids, and one contract will expire before the other - I'm going to leave it to both of them and die hoping that they can work the details out for themselves. Heck - I won't be around to be bothered by it!

The frog weighs in.........

1) I will be 82 when DVC I ends.

2) I will be 94 when SSR ends.

3) I will be 97 when AKV ends.

4) I don't plan to croak, ever!

That said.....

I predict I'll be 100 when CRV ends, and that is where I hope to expire myself. Proped up, riding shotgun in the monorail!

Each of my kids will get 1,500 points, with the balance being given to a terminal missionary charitable trust.

Otherwise I am now torn between dying peacefully at OKW (It could be weeks -of free stays) before anyone notices I'm dead, or dying at AKV and being eaten by the carnivores.

-Tony

Of course originally I was gonna leave all my points to WMD and Pete over at the DIS, but I guess if they don't want me there, they probably wouldn't want my points, right??? ;)

To all DINKS (and non-DINKS but a DINK started the thread) do your friends and family who survive your passing a favour and get a will.

My brother passed away completely unexpectedly no warning no time to prepare and without a will in place and I spent 6 months working out a small estate without probate. Larger estates (in Texas anything over 50,000 in net value) and I would have not been able to avoid an even more protracted and very expensive probate proceeding.

Get a will now - either specify heirlooms going to specifc people or specify sell it all and a share ratio. Have no family or close friends at all to share with pick a charity or charities. But do your friend or family member that will be left to pick up the pieces a favour and get a will.

Sorry for the rant but I tell all my friends the first time the subject comes up to get a will now and you all (here at MouseOwners) count in that catagory so

GET A WILL NOW

I agree 100% Ken. We actually are preparing a Will now, that is why I brought up the question a little while back. I had to figure out what to do with DVC.

Being a trauma nurse, it dazzles me how people think they are going to live forever, and nothing will happen ever to them. Granted the odds are in your favor, but I have seen some horrid stuff to people not prepared. (no insurance, no disability, no Life insurance, etc)

Thanks for reminding us how important it is. I think we are going to end up doing one online and have it notarized, the attorney we called wanted a $1000 just for a prefilled out will. :faint:

you make me feel bad. no kids, so I didn't think I needed a will.

but you are correct.

I have life insurance, disability, health - but no will.:worried:

started one - but it got to complex.

at least I know a lawyer who hopefully won't charge me $1,000.:jawdroppi

Okay next weekend will get started.

can't this weekend got a wedding to attend. (can only do one major project a weekend - too much stress otherwise)

thanks again - this is something that needs to be done!!!

Cheap will, and even if you get what you pay for, you'll be dead, so it won't bother you!!!! :jawdroppi

Sorry about the rant earleir and didn't want to bring down the thread.

We put ours in place after 1st child was on teh way I understand everyone elses procrastination.

Legal Zoom is good have friends who have used it thanks for posting the link Tony

We had ours done by a member of our church it's same cut and paste and reuse existing clauses process as online but with a little hand holding on the options around best methods for conveyance and covering future children, in current documents. We paid $800 a few years back so $1,000 now sounds reasonable unless getting a best buddy or family discount.

The peaceful sleep knowing it's all taken care of was worth every penny of my $800 many times over.

:ROTFL: Well... when ya gotta go, ya gotta go and this is the way I would LIKE to go!! Well except for the 1/2 used AP...I always try to get the most out of my AP ;)

I was thinking the same thing - "wait, I can plan my AP better than that!!" :ROTFL:

I think I'd do like Kim. Liquidate and distribute evenly. I'd like to earmark the $ for rducation now, and howpefully live long enough that htey are all done with education by the time I go. Still need to work on a will, though.

I think more people wise up soon enough that they need an education than realize they need enjoyment and pure fun in their lives. I say leave the DVC and then worry about education...

I have already told my three girls that when they get married I will give them a Home resort with the points that go with it.the point value that each one will get is 200 at this time but it will grow in the next few years.

tiggerguy:Pirate:

That's pretty cool of you. Of course as an almost 33 year old who still isn't married (not by choice) I can't help imagine your daughters trying to convince men to marry them just so they can get their DVC inheritance. :)

I'm taking it with me. :ang2:

We haven't redone our will since buying DVC, and there's a good chance that at least one of us will outlive the deed, so we're not worrying about it just yet.

If they are offering you a Margarita, and there is a Music for the Parks CD playing I would RUN!
